Bagger — Terms of Service
1. Who we are and what this is
Bagger is a golf application for iPhone and Apple Watch. It shows you distances on the course, keeps your score, tracks the shots you confirm, and — if you subscribe — recommends clubs and answers questions based on the distances you actually hit.
These Terms are a binding agreement between you and Bagger LLC, an Oregon limited liability company ("Bagger," "we," "us"). By creating an account or using the app, you agree to them. If you don't agree, don't use the app.
Bagger is available on Apple iOS and watchOS only. There is no Android version and no Google Play distribution.
2. Eligibility
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use Bagger only with a parent or guardian's involvement, and they agree to these Terms on your behalf.
3. Your account
Bagger requires an account. You can create one with an email address and password, or by signing in with Apple or Google. There is no anonymous or guest mode — your rounds and shot history are tied to a real account so the app can learn from them.
You are responsible for keeping your sign-in credentials secure and for activity that happens under your account. Tell us at support@getbagger.com if you believe someone else has accessed it.
One account per person. Don't share credentials, and don't create accounts to evade a suspension.
4. What's free and what's paid
Free, with an account and no payment:
- GPS distances to the front, center, and back of the green
- Score and putt tracking, and your round history
- Carry and clear distances to hazards from where you're standing
Bagger Pro, by subscription:
- Club recommendations based on your own logged distances
- The voice caddy — up to 10 spoken questions per round
- Detailed shot-by-shot advice, including where it's safer to miss
- Post-round insights
- Personalized club distances that update as you play
The 10-question voice limit applies to every Pro subscriber. We do not offer, and these Terms do not promise, unlimited voice interaction.
We may change what's included in each tier. If we remove something material from the free tier or from a tier you're currently paying for, we'll tell you before it takes effect, and you may cancel.
5. Subscriptions, billing, and cancellation
Price and term. Bagger Pro is $9.99 per month or $79.99 per year. A 7-day free trial is available to new subscribers. Prices are in U.S. dollars and may differ in other currencies and regions.
Apple bills you, not us. All subscriptions are sold through Apple's App Store and charged to your Apple Account. We never see or store your card details.
Automatic renewal. Your subscription renews automatically at the end of each period — monthly or annually — unless you turn off auto-renew at least 24 hours before the current period ends. Apple charges the renewal within 24 hours before the period ends. If you started a free trial and don't cancel before it ends, it converts to a paid subscription at the price above.
How to cancel. Open the Settings app on your iPhone, tap your name, tap Subscriptions, select Bagger, and turn off auto-renew or cancel. You keep Pro access through the end of the period you've already paid for. Deleting the app does not cancel your subscription.
Refunds are handled by Apple under its own policies, not by us. You can request one at reportaproblem.apple.com. We can't issue refunds for App Store purchases directly, though we'd like to hear from you at support@getbagger.com if something went wrong.
Price changes. If we change the subscription price, Apple will notify you and, where required, ask you to consent before the new price applies to a renewal. You can cancel instead.
Promotional offers (introductory pricing, offer codes, comped access) are limited-time, may be restricted to new subscribers, and are not transferable or redeemable for cash.
6. Deleting your account
You can delete your account and all of your Bagger data at any time from inside the app: Profile → Account → Delete Account.
Deletion is permanent. It removes your profile, your rounds, your scores, your shot history, and your saved clubs from our systems. It cannot be undone, and we cannot restore the data afterward. If you subscribe, deleting your account does not cancel your Apple subscription — cancel that separately in your Apple Account settings, as described above.
We may retain limited records where we're legally required to, such as transaction records for tax purposes.
7. Your data and what we do with it
Your golf data is yours. The shots you confirm, the scores you enter, the clubs in your bag, and the distances the app learns for you belong to you.
You grant us the license we need to run the service: to store your data, process it, and use it to generate the distances, recommendations, and insights the app shows you. That's the product working as intended.
We also use aggregated and de-identified data — information that no longer identifies you or your account — to improve how Bagger performs for everyone, including improving the accuracy of its recommendations. We do not sell your personal information, and we do not share your identifiable golf data with advertisers or data brokers.
How we collect, use, and share your information — including location, voice recordings, and Apple Health data — is described in our Privacy Policy at https://getbagger.com/privacy, which is part of these Terms.
8. Acceptable use
Don't:
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Use automated means to access our servers, or make requests at a volume or rate that isn't ordinary personal use
- Attempt to circumvent subscription controls, usage limits, or access features you haven't paid for
- Resell, sublicense, or commercially redistribute the app or its output
- Upload unlawful content, or use the app to harass anyone
- Interfere with the app's operation or attempt to gain unauthorized access to another user's account or data
We may suspend or terminate an account that does any of this.
9. Golf advice, accuracy, and safety — read this one
Bagger gives you information and suggestions. It does not guarantee results.
Distances are estimates. Bagger uses your device's GPS, which is affected by weather, terrain, tree cover, and hardware. Yardages, hazard carries, and green distances are approximations. Do not rely on them for any decision where accuracy matters. Confirm against course markers when it counts.
Club recommendations are suggestions. They're generated from your own logged shots, general priors, and the conditions the app can see. They can be wrong. The decision — and the shot — is always yours.
Play safe. Never look at your phone or watch while someone near you is swinging, and never let the app distract you from where other players are. You are responsible for your own safety and for following the course's rules, pace-of-play expectations, and any restrictions on device use.
Competition play is your responsibility. The Rules of Golf treat distance information and advice differently, and many competitions that permit a distance-measuring device do not permit club-selection advice. If you're playing in a competition, it's on you to know and follow that competition's rules. Using Pro features during a round where they aren't permitted may make your score invalid — that's between you and the committee, not us.
Not health or fitness guidance. Bagger reads workout and walking data from Apple Health when you allow it, to show you what you did during a round. None of it is medical advice, and none of it should be used to diagnose or treat anything.
10. Third-party services
Bagger depends on third parties to work — Apple, our cloud infrastructure provider, our mapping and course-data providers, and the AI providers that power the caddy's answers and its voice. Their availability, accuracy, and pricing aren't under our control. Course maps and green data come from third-party providers and may be outdated or incorrect for a given course.
11. Availability, changes, and beta features
We're a small operation and we ship often. We may add, change, or remove features; take the service down for maintenance; or discontinue it entirely. If we discontinue Bagger while you have an active paid subscription, we'll give you notice and work with Apple on a fair outcome for the unused portion.
Some features may be labeled beta or experimental. Those are provided as-is, may not work correctly, and may disappear.
12. Our intellectual property
The app, its design, its wordmark, and everything in it other than your own data belong to us or our licensors. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Bagger on Apple devices you own or control, for your own non-commercial use. That's the whole license — no other rights are granted.
13. Disclaimers
BAGGER IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DISTANCE, YARDAGE, HAZARD MEASUREMENT, CLUB RECOMMENDATION, OR INSIGHT WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR SHOT OR DECISION.
No advice or information you get from us or from the app creates any warranty not expressly stated here.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. In that case, our warranties are limited to the minimum extent permitted by the law that applies to you.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF BAGGER — EVEN IF WE HAVE BEEN ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO BAGGER WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR BAGGER IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).
These limits apply to every theory of liability — contract, warranty, negligence, strict liability, or otherwise — and they survive any failure of an essential purpose of a limited remedy.
What these limits do not cover. Nothing in these Terms limits or excludes our liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or death or personal injury caused by our own negligence, or any other liability that cannot be limited or excluded under the law that applies to you. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above may not apply to you in full.
You and we agree that these limits are a fundamental basis of the bargain — Bagger is offered at a free tier and at a low subscription price precisely because liability is bounded this way.
15. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the app or your violation of these Terms or of applicable law.
16. Termination
You may stop using Bagger at any time and delete your account as described in §6. We may suspend or terminate your access if you materially breach these Terms, or if we're required to by law. Sections that by their nature should survive termination — §7's aggregated-data provision, §12, §13, §14, §15, and §17 — survive.
17. Governing law and disputes
Talk to us first. Before filing anything, email us at support@getbagger.com describing the problem and what you'd like us to do, and give us 30 days to resolve it. Most problems are a refund and an apology, and we would rather give you both than argue. This step is a requirement before either of us starts a formal proceeding.
Governing law. These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law rules — except that nothing here deprives you of the protection of any mandatory consumer-protection law of the place where you live.
Where disputes are heard. You and we agree that any dispute not resolved informally will be brought in the state or federal courts located in the State of Oregon, and we each consent to their jurisdiction. Small claims are the exception: either of us may bring a qualifying claim in small claims court, including in your own local jurisdiction. For a subscription at this price, small claims is usually the faster and cheaper path for everyone, and we won't object to it.
No arbitration clause. These Terms deliberately contain no mandatory arbitration provision and no class-action waiver. We would rather resolve a $79.99 dispute by refunding it.
18. Apple
You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for Bagger or its content. Apple has no obligation to provide maintenance or support for Bagger. If Bagger fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Bagger. Apple is not responsible for addressing any claim by you or a third party relating to Bagger, including product liability, legal or regulatory non-compliance, or consumer protection claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
19. Changes to these Terms
We may update these Terms. If a change is material, we'll notify you in the app or by email before it takes effect. Continuing to use Bagger after that means you accept the updated Terms. The "Last Updated" date at the top always reflects the current version.
20. General
These Terms are the entire agreement between us about Bagger. If any provision is found unenforceable, the rest stays in force. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
